Wyoming Free Menstrual Hygiene Products In Custody Act


Bill

Provision of Free Menstrual Products in Prisons.



Mandatory provision of menstrual health hygiene products:

  1. Every covered facility should provide menstrual health products at no cost to any person in custody that requests them.

  2. Products should be provided:

    1. In a way that does not demean the individual requesting them;

    2. In adequate quantities to meet individual needs;

    3. Without requiring the person in custody to justify the request;

    4. Within a reasonable amount of time after request has been made, not to exceed 3 hours except in emergency situations.

  3. No covered facility may:

    1. Charge any fee for menstrual hygiene products;

    2. Limit the quantity of products provided below what is medically necessary;

    3. Require medical documentation or verification of menstrual products.

Definitions

  1. “Covered facility” means:

    Local and municipal jails.

    State correctional facilities. 

    Juvenile detention facilities.

    Any other facility that operates under contract with the state, county, or municipality that houses individuals overnight.

  2. “Menstrual product” means:

    Pads.

    Tampons.

    Menstrual cups.

    Menstrual underwear and reusable pads.

  3. “Person in custody” means any individual who is detained, incarcerated, or otherwise held in a correctional facility.
