Proposal Summary

Purpose

The purpose of this legislation is to safeguard the privacy of menstrual health and related personal data in New York State. It will close gaps in existing law (such as HIPAA) that leave fertility and menstrual tracking information unprotected, and ensure that individuals’ sensitive reproductive health data cannot be collected, shared, or sold without their affirmative consent. This Act is intended to empower New Yorkers with control over their menstrual health information and prevent misuse of that data by private companies or other entities.
