Kansas Menstrual Products Safety Act


Bill

Regulating menstrual products transparency.


Ingredient Disclosure Requirements

  • All menstrual products sold in this state must list all ingredients on the package.

  • Ingredients must be listed in descending order by weight or concentration.

  • Font size must be legible.

  • Ingredients must use standardized chemical names.

  • Digital/QR codes are not sufficient-full ingredients must be listed on the physical packaging.


PFAS Prohibition

  • Complete ban on manufacturing, distributing, selling, or offering for sale any menstrual products containing PFAS.

  • Full prohibition effective.

  • Applies to all PFAS chemicals, both intentionally added and present at detectable levels.

  • Covers all menstrual products.


Harmful Chemical Regulations

  • Prohibition of specific harmful chemicals in menstrual product manufacturing including:

  • Heavy metals (lead, mercury, cadmium).

  • Volatile organic compounds (VOCs).

  • Phthalates.

  • Formaldehyde and formaldehyde-releasing agents.

  • Chlorinated compounds used in bleaching.

  • Synthetic fragrances containing allergens.


Toxic Shock Syndrome (TSS) Warning Requirements:

  • All tampons and menstrual cups must include prominent TSS warning on package.

  • Must include specific language about TSS symptoms and risk factors.

  • Warning must be in English at a minimum.

  • Internal package inserts must include detailed TSS information and prevention guidelines.

Implementation

Timeline

  • Law takes effect immediately upon signing.

  • Ingredient and TSS labeling requirements: 6 months after effective date.

  • PFAS and harmful chemical prohibitions: 18 months after effective date.

  • Full enforcement begins 24 months after effective date.

Definitions

  • “Menstrual Product” means a product used to collect menstruation and other vaginal discharge, including, but not limited to, tampons, pads, sponges, menstruation underwear, and menstrual cups.

  • “Perfluoroalkyl and polyfluoroalkyl substances” or “PFAS” means a class of fluorinated organic chemicals containing at least one fully fluorinated carbon atom. 

  • "Intentionally added PFAS" means PFAS that are deliberately added during the manufacturing of a product or product component where the continued presence of PFAS is desired in the final product or product component to provide a specific characteristic, appearance, or quality.

  • "Person" means any individual, corporation, company, association, society, firm, partnership, joint stock company, or any other entity.

  • “Harmful chemicals” means substances known or suspected to cause reproductive harm, cancer, or endocrine disruption.
